EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the ��'� day of October 2004, at 6:30 p.m. <br />The following members were present: <br />and the following were absent: <br />Council Member introduced the following resolution and moved its adoption: <br />RESOLUTIONNO. <br />A RESOLUTION APPROVING T HE VACATION OF A UTILITY & DRAINANGE <br />EASEMENT WITHIN APPLEWOOF POINT OF ROSEVILLE (PF3602). <br />WHEREAS, United Properties has requested the vacation of a utility and drainage <br />easement dedicated with the original Applewood Pointe of Arona subdivision in 2003; and <br />WI�REAS, the easement ios located on property legally described as: <br />the South 27.11 feet of the West 48.00 feet of the East SS.00 feet of Outlot "A ", Applewood <br />Pointe of Arona 2nd Addition <br />WHEREAS, the Public Works Department has determined that the requested utility & <br />drainage easement is no longer necessary for public infrastructure; and <br />WI�REAS, the Roseville Planning Commission held a public hearing regarding the <br />Easement Vacation request and voted (5-0) to recommend approval its vacation, based on the <br />fmdings of Section 5.10 to 5.12 and the condition of Section 8 of the project repot dated October <br />14,2004; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant the <br />VACATION of a UTILITY & DRAINAGE EASEMENT (as described above) to United <br />Properties based on the fmdings in Section 5.10 to 5.12 of the project report dated October 25, <br />2004, and subject to the following conditions: <br />L The provision of a 10 foot wide storm sewer force main easement on the south <br />property line, a pathway easement, and an easement for the public overlook. <br />2, The relocation of the proposed retaining wall outside of the storm sewer force <br />main easement. <br />3. A revised landscape plan to include a decorative fence and landscaping that will <br />screen and separate the town homes from the public path. <br />
