and construction including, but not limited to, the issuance of building permits <br />for lots which the DEVELOPER may or may not have sold, until the bills are <br />paid in full. Bills not paid within thirty (30) days shall accrue interest at the <br />rate of nine percent (9%) per year. <br />E. In addition to the charges referred to herein, other applicable charges may be <br />imposed such as, but not limited to, sewer availability charges ("SAC"), city <br />water connection charges, city sewer connection charges, city storm water <br />connection charges and building permit fees. <br />18. Building Permits. No building permits shall be issued until the following items are <br />complied with: <br />A. In order to provide emergency vehicle access, a passable Class 5 road base <br />must be extended to within 150 feet of any address seeking a building permit. <br />To the extent that it helps, footings and foundations and basements are not <br />considered structures and therefore, it would be possible to do this work <br />anywhere on the site beyond the 150 foot radius from a Class 5 drive. The <br />CITY may issue building permits for these structures with a limitation that the <br />construction not extend beyond the basement until emergency vehicle access <br />can be provided. <br />B. Temporary address numbers shall be displayed on the building site during <br />construction. <br />C. While building permits may be issued on a Class 5 road base, certificates of <br />occupancy will not be issued until curb and gutter and bituminous surfacing <br />(at least the first lift) are installed. Other occupancy standards include the <br />installation of a hard surface driveway, and boulevard landscaping. <br />D. In order to protect against erosion and to maintain the cleanliness of the site, <br />erosion control will be required as indicated in Paragraph 11. Cement trucks <br />must be cleaned before leaving the project. <br />E. Curb cuts by builder shall be constructed as per CITY specifications for <br />replacing concrete curbs and driveways. <br />19. Certificate of Occuuancv and Certificate of Comuletion. These certificates shall not <br />be denied solely due to failure by the CITY to construct the Arona Pond, Arona Pond <br />Pathway, or Terrace Drive Extension as described in Paragraphs 3F, 3G, and 3H hereof. <br />20. DEVELOPER'S Default. In the event of default by the DEVELOPER as to any of the <br />work to be performed by it hereunder, the CITY may, at its option, perform the work and <br />the DEVELOPER shall promptly reimburse the CITY for any expense incurred by the <br />CITY, including personnel and attorney's fees, provided the DEVELOPER is first given <br />Page 7 of 11 <br />
