� .� <br />� <br />- October 8, 2404 <br />.4L SANDS <br />ADDITIONAL COMMENTS TO PLANNING COMMISSION FOR OCTOBER 14 <br />RE: TWIN LAKES HEARING <br />R�: A CLOSE LOOKAT THE B6 ZONING DESIGaVAT20N <br />HISTORY: <br />The B6 designation for Twin Lakes was concocted by the Community <br />Development Department (Dennis Welsch et al) in 2001 as its way to provide a way to <br />zone for mixed uses. At the same time, it required a P.U.D. be completed before any use <br />would be permitted. By mandating the only way a B6 designation can be implemented is <br />by the com�letion of a planned unit development agreement, it transfers effective control <br />over the use of a property to mutual consent of the city and the owner(s). In other words, <br />once zoned B6, the City can now prevent a parcel &pm �n use other than one agreed to <br />through a development agreement. This is contrary to the historical function of zoning, <br />which is to PROVIDE A LIST OF PERMITTED USES. Please note a B6 designation <br />only provides for any use after a P.U.D. is completed. <br />Also, please note that a huge retail big box does not conform to a permitted use. <br />� st�ff report 7.3. A B6 designation only provides for the presence of su000rt <br />services, such as limited retail, health, fitness, lodging, and multifamily housing. While <br />the city attorney claims that limited retail actually means unlimited retail, I violently <br />disagree. It's clear the intent is to have � retail be something that supports the office <br />park per se, A big box is intended to "draw" fiom a large (regional) market. It creates a <br />regional shopping center, and is contrary to being a part of a business park district where <br />the mix of uses is inter related and su�ort each other. The intent of a big box is to be a <br />retail "engine" that will draw customers fiom a large regional area outside the business <br />park, in the expectation customers ro drawn to the site will also shop at the strip mall and <br />restaurant portion of the retail area. The big box is designed to draw enough customers, <br />fiom outsidethe business park per se, to the malls and restaurants to entice those retailers <br />to set up shop there, and thereby create another regional shopping center. The planned <br />retail portion would have to be scaled way back if it's only function was to serve the <br />business park area. And that's what should happen. <br />� <br />
