A RESOLUTION AUTHORIZING EXTENSION OF DEADLINES IN THE CONTRACT FOR EXCLUSIVE NEGOTIATIONS BETWEEN THE CITY OF ROSEVILLE, MINNESOTA AND THE ROTTLUND COMPANY, INC. FOR THE TWIN LAKES REDEVELOPMENT AREA BE TT RESOLVED by the City Council (the "Council") ofthe City of Roseville, Minnesota (the "City"), as follows: Section l. Recitals. 1.O 1 On March 29,2004, the Council designated The Rottlund Company, Inc. ("Rottlund") as the Master Developer of the Twin Lakes RedevelopmentArea ("Twin Lakes") and approved a Contract for Exclusive Negotiations with Rottlund (the "Contract") which expires on March 3 l, 20Q5. 1.02 On September 27,2004, the Council determinedthat Rottlund had met requirements in the Contractthat it successfullycomplete certain actions by September30,2004 relatingto Phase I of the redevelopment (which includes Areas 1 through 5 and 8), thereby allowing the Contract to continue in effect according to its terms. 1.03 The Contract requires Rottlund to complete further actions by December 31,2004 and, if such actions are completed, provides that the City and Rottlund intend to execute a RedevelopmentAgreementby March 31,2005. 1.04 At its October25,2004 meeting, the Council declinedto take action withrespectto a proposed amendment to the Twin Lakes Master Site Plan and preliminary plat, rezoning, and General Concept Planned Unit Development Plan relating to Phase 1 of the redevelopment, as a result of the City having receivednotificationthat the MinnesotaEnvironmental Quality Board (the "EQB") had received a petition pursuant to Minnesota Rules, Part 4410.11, requesting that an Environmental Assessment Warksheet ("EAW) be prepared relating to the proposed redevelopment.
