�ep�r t �►gpr��}��I: <br />� <br />�� <br />REQUEST FOR COUNCIL ACTION <br />Manager Reviewed: <br />Item Description: Approval of Fulham Street Encroachment Agreement <br />DATE: 11 /22/04 <br />ITEM: �_� <br />Agenda Section: <br />Constnr <br />Background: Bonestroo, Anderlik, Rosene, and Associates (Bonten) is a civil <br />engineering/architectural firm located at 2335 Fulham Street. Their company also leases space in <br />the Roseville West Building across the street at 2277 Fulham Street. They are interested in <br />installing fiber between these two buildings to provide a computer network connection to their <br />employees that work in the leased space. In order to do this they wish to cross the City of <br />Roseville's Fulham Street right- of- way, and establish an underground conduit for this fiber <br />connection. <br />We have discussed this request with the city attorney and have drafted an encroachment <br />agreement with Bonten for a"permanent private facility" in our public right- of- way. <br />Financial Implications: There is no public financial participation requested. The fiber will be <br />installed using a trenchless construction technique so there will be no excavation within the <br />City's right- of- way. Due to this manner of constructionwe are anticipating no impacts to the <br />driveabilityor the life of the public street. The agreement indemnifies the City frorn any <br />damages to Bonestroo due to the regular use of the public right- of- way. It also protects the City <br />from any damages to the City or other right- of- way users because of the facility. <br />Staff Recommendation: Staff recommends Council approval of this encroachment agreement. <br />RECOMMENDED COUNCIL ACTION: <br />Motion to approve encroachment agreement with Bonten for Fulham Street right- of- way. <br />Prepared By: Deb Bloom <br />
