REQUEST FOR CITY COUNCIL ACTION <br />DATE: 0 1 /24/00 <br />ITEM NO: z - 3 <br />Approved: Agenda Section: <br />�� LAND USE <br />Ite4n Description: City of Roseville request for City Code interpretation. <br />1.0 BACKGROUND <br />l.l The Roseville staff is charged with administering the City Code. Part of this administration <br />includes the interpretation of many section requirements. In the event our interpretation is <br />challenged, a request is made to the City Council for a final determination regarding proper <br />administration of the City Code. <br />2.0 REVIEW of REQUEST , <br />2.1 Mark Battis, Adrian Keller, and other residents adjacent to the eastern edge of Har Mar Ma11 <br />have challenged the staff interpretation of Section 1006.02.C, Lot Coverage, of the Roseville <br />Zoning Ordinance. <br />2.2 Section 1006A2.C. states: Not more than twenty-five percent (25%) of the lot area shall be <br />occupied by buildings. <br />2.3 Staff interprets (underlining) Section 1006.02.C. of the City Code as follows: Lot Coverage: <br />Not more than twenty-five percent (25%) of the shopping center master planned lot area <br />sha11 be occupied by the commercial building footprint which includes area within the <br />exterior walls of all commercial buildings. The "Master Planned" lot area includes the <br />main structure, all outlots, non-buildable pond, landscaping, setback, and buffer areas; all <br />r�'mciple commercial structures or accessory structures; and accessory parking and parking <br />structures within the legal description(s) of the site. The lot area must be defined within <br />a boundarv survev combleted bv a state re�istered land survevor. The boundarv survev <br />must also mclude the square toota�e of all buildm� tootprints and the lot area m <br />2.4 Staff has used this interpretation for a number of years as a measure of consistency <br />throughout the Shopping Center District. <br />3.0 REVIEW of ISSUE <br />3.1 The challenge has to do with what land area is used to determine whether a site conforms to <br />the 25% lot coverage requirement. Staff requires submittal by a Registered Land Surveyor <br />of a boundary survey of the legal description to verify lot coverage. A boundary survey does <br />not illustrate easements, excepticns, or road right-of-way dedications. It is the legal <br />description of record for a given parcel. <br />
