9.11 Project Signage. The project will be allowed one project identification <br />sign in accordance with site and sign plans and detail (Exhibit J)> and <br />in accordance with the City Code. The project sign shall be designed <br />to complement the architecture and appearance of the building. <br />9.12 Recreational Vehicles and other Vehicles over One Ton. Motorized <br />recreational vehicles and vehicles over one ton carrying capacity> <br />and/or trailers> shall not be parked or stored within the development. <br />9.13 Ponding and Surface Water Management. The Developer shall adhere to <br />City and Rice Creek Watershed Surface Water Management provisions <br />and regulations> National Water Run-Off Program standards> and any <br />applicable best practices standards to construct and provide surface <br />water management. <br />9.14 Driveway Access to Adjoining Properties. The Developer may permit <br />abutting property owners to the west or north to provide driveway <br />access easements across the project property to abutting property. <br />9.15 Future Acquisition ofNorth 64 feet ofParcel for Park and Parking Purposes. <br />At a future time> the developer may sell> provide easements> <br />dedications> or in other manner provide title> access> or use agreements <br />or easements> to the City for the northerly 64 feet by 294 feet <br />(approximately) or a portion thereof. <br />10. Developer's Default <br />In the event of a default by the Developer> as to any of the work to be performed <br />by it hereunder> the City may withhold the certificate of occupancy from the <br />Developer. <br />The City agrees to give the Developer written notice of its default not less than <br />thirty (30) days prior to the commencement of the city's work to correct the <br />default. The City and the Developer recognize the weather conditions may affect <br />the ability of the Developer to perform the work required to be performed <br />hereunder and agree that such thirty (30) days shall not include those days on <br />which weather conditions preclude performance by the Developer. <br />Notice to the Developer shall constitute> without further action> notice to any <br />contractor of subcontractor. If deemed impractical by the City> the above notice <br />requirements shall not be required for the city to control erosion or drainage <br />problems which cause damage beyond the project property lines. <br />Page 8 of 10 <br />
