MU.LIC,AN <br />.IO6EP1/ C�ITIS <br />� MSO ADA111'TED M WISCONSIN <br />" ODLY ADMITTEU M/ (%1LIFORNIA <br />This letter is submitted in support of Bradley Operating Limited Partnership's (`Bradley") application to <br />the City of Roseville ("City") for a variance from the provisions of Section 1006.02(C) and 1011.02 of the <br />Roseville Zoning Ordinance ("Zoning Ordinance") for a Cub Foods grocery store in the southeast comer <br />of the Har Mar Mall in space most recently occupied by Home Place. Section 1006.02(C) of the <br />Shopping Center District section of the Zoning Ordinance regulates lot coverage. It states: "Not more <br />than twenty-five percent (25%) of the lot area shall be occupied by buildings." Section 10 11.02 of the <br />Zoning Ordinance prohibits expansion of nonconforming uses. Section 1011 .O1 of the Zoning Ordinance <br />defines nonconforming use as: "Any use or arrangement of land or structures legally existing prior to the <br />enactment of a code provision prohibiting such use." <br />The Cub Foods project involves demolition of the existing Home Place structure and reconstruction of a <br />new expanded structure to accommodate the proposed grocery store use. The project includes enclosed <br />loading and trash facilities as required by Ordinance No. 1234 which amended the City Code to establish <br />new restrictions applicable to "twenty-four hour uses." The Cub store without the enclosed loading and <br />trash will add 13,537 square feet to the existing Har Mar Mall shopping center building. The Cub store <br />with the enclosed loading and trash will add 18,508 square feet of building to the existing Har Mar Mall <br />shopping center building. <br />
