C--\'� � <br />Item Description: <br />BACKGROUND <br />Date: 3/27/00 <br />Item No.: J- 1 <br />Agenda Section: <br />Ordinances and Resolutions <br />Review Draft Changes in Roseville Liquor License Requirements <br />Currently, for a first offense a seller to an underage purchaser receives an Administrative Offense <br />Ordinance citation for $100.00. If that same person commits a similar violation within the year, the <br />fine is raised to $125.00. For a first offense, the license holder receives an Administrative Offense <br />Ordinance citation for $150.00. A second violation within the year results in a two-day suspension <br />of the establishment's liquor sales. A third violation results in a five-day suspension. <br />In 1998, we conducted two alcohol sales compliance checks. The first check resulted in 22 failures <br />out of 38 license checks. The second check resulted in 13 failures in 38 checks. A marked <br />improvement. Six establishments failed twice and received a two-day alcohol sales suspension. <br />In 1999, we conducted two alcohol compliance checks. The first check resulted in eight failures out <br />of 38 checks; the second check resulted in three failures in 39 checks, an improvement over last <br />year. <br />Over the last four compliance checks, six establishments have passed all four compliance checks; <br />Fairviev� Liquors, Tower Glen Liquor, Network Liquor, Byerly's, B-Dale Club and the Midland Hills <br />cc. <br />Compliance checks are working. <br />A number of communities are including "Responsible Beverage Server Training" as part of their liquor <br />licensing requirements. This addition would include mandatory server training related to age of sales <br />violations. The City could develop the training and require the establishments to provide that training <br />within a specified time period to all the employees involved in liquor sales. If an establishment fails a <br />compliance check but shows they compiled with the training requirements, the license holder would <br />receive a warning letter stating the next failure would result in a two day license suspension. The <br />establishment would not receive a fine for the first violation. Roseville alcohol beverage establishments <br />have been working to achieve compliance. Their efforts can be undercut by non-compliant employees <br />who bear little responsibility for a license. Part of the ordinance change would be to raise the seller's <br />fine to $150.00 or $200.00. The extra penalty would serve to sharpen the seller's duty to ask far ID and <br />refuse sales if the person is under 2 1. <br />Another aspect of the ordinance revision would include setting receipt requirements for home delivery <br />
