SECTION 3. Section 302.15 of the Roseville City Code is amended to read as <br />follows: <br />302.15: CIVIL PENALTY: <br />A. Penalty for Noncompliance: In addition to any criminal penalties which may <br />be imposed by a court of law, the City Council may suspend a license for up to <br />sixty (60) days, may revoke a license and/or may impose a civil fine on a licensee <br />not to exceed two thousand dollars ($2,000.00) for each violation on a finding that <br />the license holder or its employee has failed to comply with a statute, rule or <br />ordinance relating to alcoholic beverages, nonintoxicating malt liquor or wine. <br />B. Minimum Penalty: In no event shall a penalty be less than: <br />1. For license holders who narticinate in Responsible Bevera�e Server <br />Trainin� and prove the nerson who sold or served alcohol had received <br />citv avproved alcohol bevera�e server trainin� within the previous vear: <br />a. For a first violation. the license holder will be �iven a warnin 1� etter. <br />b. For a second violation in twelve (12) months the mandator-v minimum <br />penaltv shall be the administrative nenaltv imnosed nursuant to City Code <br />subsection 102.0 1 C. <br />c. For a third violation in twelve (121 months. the mandatorv minimum <br />penaltv shall be susnension of two (21 davs. � <br />d. For a fourth violation in twelve (121 months. the mandator-v minimum <br />penaltv shall be susnension of five (5) davs. <br />2.For license holders who do not narticinate in Resoonsible Bevera�e <br />Server Trainin�: <br />a. For a first violation. the mandatorv minimum nenaltv shall be the <br />administrative penaltl! imnosed nursuant to Citv Code subsection 102.01 C. <br />c. For a second violation in twelve (12) months, the mandatorv minimum <br />penaltv shall be susnension of two (2) davs. <br />d. For a third violation in twelve ( 121 months. the mandator-v minimum <br />penaltv shall be susnension of five (51 davs. <br />
