(PF3209) <br />1.0 Requested Action <br />l.l The Roseville Lutheran Church has submitted an application for a variance from the zoning <br />code to allow completion of the 300 seat area in their worship center balcony. In order to <br />meet City Codes, the Church must also add 85 off-street parking spaces to handle the <br />expected additional attendees at Sunday services. This would require expansion of the <br />existing parking lot to the edge of the adjacent park property or in other locations at the <br />church site at 12 15 Roselawn Avenue. The Church is requesting the variance to retain green <br />space rather than pave the remaining green space on this portion of the site. The Church held <br />a neighborhood meeting on this topic on May 1, 2000. <br />2.0 Background <br />Minnesota Statutes 462.357 provide variance requirements which the City has adopted in <br />City Code Section 1013.02. The applicant is required to provide the burden of proof that a <br />variance from the existing code is necessary. The applicant must demonstrate a unique <br />physical hardship on the site; that no practical alternative e�sts to resolve the issue; that the <br />variance request is not based solely on economic reasons; and that the need for the variance <br />was not created by the applicant. <br />The Church is located in an R-1 Single Family residential zone and as such is a permitted <br />use, with a parking ratio of 1 space to 3.5 seats at capacity in accordance with Section <br />1005.O1D2p of the City Code. <br />The Church currently has a 10,000 s.f. worship center (1996) and proposes to complete the <br />seating within 3,700 s.f. along the north and west sides of the balcony. There are currently 194 <br />spaces in the south lot and 82 spaces in the north lot for a total of 276 spaces. The site plan also <br />has enough space to pave an area for a11 new, required 52 spaces (actually proposed 56) in a <br />double row directly adjacent to the west property line of Bruce Russell Park. (There remains <br />some question whether the letter and intent of the original agreement and approved site plan <br />allows further movement eastward toward the properry line of Bruce Russell Park.) This <br />parking expansion would add approximately 16,000 s.f. of new pavement to the area. Since the <br />original application, the Church has amended its request to avariance for 25 spaces, the number <br />of spaces proposed not to be built.
