C 0 PY <br />WIEDEN GARAGE AGREEMENT <br />An Agreement dated this 30 day of June, 2000, by and between Kenneth C. Wieden, a single person, <br />hereinafter called "Resident" and the City of Roseville, Minnesota, hereinafter called "Roseville". <br />WITNESSETH: <br />Whereas, Roseville received a temporary construction easement and executed a earnest money contract <br />with the Resident for construction of a pathway within the Dale Street right-of-way abutting his property; and <br />Whereas, the Resident has received a variance from the City Council to construct a detached two-car <br />garage on his property, and <br />Whereas, because of the variance, it is necessary to amend the Earnest Money Contract made between <br />the Resident and Roseville; and <br />Whereas, as part of the plans for the Dale Street Pathway, Roseville anticipated spending $8,000 to <br />correct deficiencies of the existing Dale Street driveway; and <br />Whereas it is in the best interest of the general public and the Resident to remove the Dale Street <br />driveway; <br />NOW. THEREFORE, IT IS MCTTUALLY AGREED BY AND BETWEEN THE RESIDENT AND <br />ROSEVILLE AS FOLLOWS: <br />1. The following items from the Easement No. 14-1 1-811 98-11 #39 earnest money contract are no <br />longer required and are hereby removed, (a copy of which is attached): <br />7. The City will construct a 12' x 15' concrete turn around approximately 2 feet west of the easterly <br />property line as a part of this trail construction proj ect. The landowner grants the temporary <br />easement area to construct the turn around as a part of this agreement. No additional <br />compensation will be awarded. . <br />9. The driveway will be widened to 20 feet at the Dale Street curbline, and taper to existing width <br />at garage. <br />2. Roseville's Contractor will remove a portion of the lilac bush at the Northeast comer of the property. <br />3. Roseville's Contractor will remove the existing concrete driveway and curb cut onto Dale Street as a <br />part of the City project, with an exception of the panel closest to the garage. A driveway in this <br />location will not be reconstructed by either Roseville or the Resident. <br />Roseville will contribute $8,000 towards the construction of the new two-car garage.
