Code <br />REQUEST FOR PLANNING COMMISSION ACTION <br />: <br />D A T E: 07/24/00 <br />ITEM NO: I-6 <br />Agenda Section: <br />LAND USE <br />�t�n ITescription: A request by Dean Sabetti for a Variance from Section 1004.02D4 of the <br />Roseville Citv Code. (PF32331 <br />1.0 REQUESTED ACTION <br />l.l Dean Sabetti, 2016 Beacon Street, is requesting a 20 foot comer lot variance from <br />Section 1004.02D4 of the Roseville City Code to allow construction of a 10 foot by 21 <br />foot (2 10 square foot) addition to the existing attached garage. <br />1.2 <br />2.0 <br />2.1 <br />The purpose of the request is to construct a ramp inside the garage addition for better <br />wheelchair access from the home to their vehicle. <br />REVIEW of REQUEST <br />Mr. Sabetti's property is a comer lot where a 30 foot side yard setback is applied to the <br />property line adj acent to Shryer Avenue. <br />2.2 Mr. Sabetti's current home and attached garage was constructed in 1955 and is <br />considered a pre-existing non-conforming use, due to the structure proximity (10 feet) <br />from the north (comer lot) properry line. <br />2.3 Section 1011.02 (Existing Structures or Uses) states: Except where specifically limited <br />elsewhere in this Code any nonconforming use may be continued but may not be extended, <br />expanded, intensified or changed unless to a conforming use. <br />Condition <br />30 footprincipal structure 10 foot principal structure <br />side yard setback adj acent side yard setback adj acent <br />to street to street <br />3.0 STAFF COMMENT <br />10 foot side yard setback for <br />principal structure and <br />addition <br />Variance <br />20 foot side yard <br />setback adj acent <br />to street <br />3.1 Variances may be granted where the strict enforcement of the literal provisions of the <br />ordinance would cause "undue hardship".
