2.3' This property was platted prior to 1959; therefore, a side yard setback of five feet is <br />required. In order to comply with building codes and setback requirements, the new <br />garage will be constructed at least six feet from the house and at least five feet from <br />the south property line. <br />2.4 Section 1004.01A, City Code, states, "no accessory building shall be erected or <br />located within any yard other than the rear yard except for a through lot when it shall <br />be located in the side yard." <br />3_0 MINOR VARIANCE COMMITTEE <br />3.1 The request for the variance included the required application form, sketch of the <br />property and proposed garage, written statement from the applicant, and written <br />approval from the adjacent property owners affected by the variance (Roger <br />Loveiand and Debra Amlee-Loveland at 2950 Woodbridge Street N). <br />3.2 The Minor Variance Committee reviewed this request on July 22, 1997, and <br />unanimously recommended approval of a minor variance to allow the placement of <br />a two car detached garage in the side yard and in line with the existing house at <br />2958 Woodbridge Street, based on the following findings: <br />The existing one car garage is located approximately two feet from the north <br />property line and the existing driveway is approximately-three feet over the <br />north property line. A 20" retaining wall in this location and the narrow width <br />of the driveway results in the accumulation of snow in this area and makes <br />it difficult to access the garage. <br />2. The new garage will be constructed in line with the front of the house on the <br />property; however, the garage cannot be attached because of the location of <br />required egress windows on the south side of the house. <br />3. There is no other practical location for a garage, either detached or attached, <br />on the property. In order to place the garage in the rear yard on the south <br />side of the parcel, an existing patio area would need to be reconstructed. <br />4. The width of the driveway will not exceed 26 feet at the property line. <br />5. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br />B.
