SECTION 3. Section 302.15 of the Roseville City Code is amended to read as <br />follows: <br />302.15: CIVIL PENALTY: <br />A. Penalty for Noncompliance: In addition to any criminal penalties which may <br />be imposed by a court of law, the City Council may suspend a license for up to <br />si�ty (60) days, may revoke a license and/or may impose a civil fine on a licensee <br />not to exceed two thousand dollars ($2,000.00) for each violation on a finding that <br />the license holder or its employee has failed to comply with a statute, rule or <br />ordinance relating to alcoholic beverages, nonintoxicating malt liquor or wine. <br />B. Minimum Penalty. piirpose of this Section is to establish a standard by <br />which the Citv Council determines the len�th of license sus�ensions and the <br />proprietY of revocations, and shall applv to all premises licensed under this <br />Cha�ter. These �enalties are �resumed to be a�ro�riate for everv case: however, <br />the Council mav deviate in an individual case where the Council finds that there <br />exist substantial reasons makin� it more a�ropriate to deviate, such as, but not <br />limited to. a licensee's efforts in combination with the State or City to prevent the <br />sale of alcohol to minors or_ in the converse_ when a licensee has a historv of <br />re�eated violations of state or local lic�uor laws. When deviating from these <br />standards, the Council will provide written findin�s that s�ppo�t the penalty <br />selected. <br />The following violations are �resumed to rec�uire revocation of the license on the <br />first violation. <br />. Commission of a felonv related to the licensed activit� <br />. Sale of alcoholic bevera�es while license is under suspension. <br />. Sale of intoxicatin�l�iquor where onlv license is for 3.2 percent malt <br />liquor. <br />Other violations. includin� the followin� shall have a�resumed nenaltv as <br />indicated below. <br />. Sale of alcoholic bevera�es to under-a�e persons. <br />. Sale of alcoholic bevera�es to obviouslv intoxicated person. <br />. After hours saleidisnlav/consumption of alcoholic bevera� <br />. Ille a�l am�bl�in o�n premises. <br />. Failure to take reasonable steps to sto�person from leavin� premises with <br />alcoholic bevera�es (on-sale allowin� off-sale� <br />1. For ON-SALE license holders who narticinate in Optional Mana e� r and <br />Server Trainin� and prove the person who sold or served alcohol had <br />received citv a�roved alcohol bevera�e server trainin� within the <br />brevious vear: <br />
