R� � <br />�` <br />Request for Council Action <br />Date: December 11, 2000 <br />Item Number: C_ 2 <br />Depa ttt Approval Manager Approval Agenda Section <br />J <br />�Consent Agenda <br />� <br />Item Description: <br />Designation of the City Manager as the Responsible Authority and Data Practices Compliance Offkial <br />Background• <br />A new law (Laws of Minnesota 2000, Chapter 468 SS 6, 7) requires that every government entity shall appoint or <br />designate an employee of the government entity to act as the Entity's Data Practices Compliance Offkial. <br />As contemplated by the statute, the Data Practices Compliance Offkial is the designated employee of the government <br />entity to whom persons may direct questions or concerns regarding problems in obtaining access to data or other data <br />practices problems. <br />E�sting law already requires the City to appoint or designate an employee as the Responsible Authority to administer the <br />requirement for collection, storage, use and dissemination of data. <br />The law expressly specifies that the entity's Responsible Authority may also be the Data Practices Compliance Official. <br />Policv Imulications: <br />The law requires appointment or designation, and the duties and responsibilities required by the law warrant the <br />appointment of the City Manager to fulfill those obligations. <br />Financial Imulications: <br />None. <br />Staff Recommendation: <br />Approve the action. <br />Council Action Reauested: <br />Motion to adopt the accompanying resolution designating the City Manager as the Responsible Authority and <br />Data Practices Compliance Offkial. <br />
