4.O BACKGROUND <br />� 4.1 In 2004, Roseville's City Council enacted a moratorium on new outdoor storage uses in <br />� the Twin Lakes redevelopment area, which included the subject property. Although the <br />� moratorium did not specifically target such uses on this property, 1705 County Road C <br />� fell within the redevelopment area; consequently, the property owners could not apply for <br />� the permanent conditional use approval. Instead, the only option for allowing the outdoor <br />� storage of boats in this location was to approve it temporarily with an Interim Use Permit. <br />� The moratorium has since been rescinded. <br />_ 4.2 While the approved Interim Use Permit expired in 2007, Soater's Outlet has continued to <br />_ operate without incident until today. Planning Division staff has been aware of the fact <br />_ that the outdoor storage of boats has been a nonconforming use since 2007, but has not <br />_ had the opportunity until recently to remind the property owners that the previous <br />_ approval was, by nature, temporary and that they needed to receive permanent (i.e., a <br />_ coNDiT1oNAL usE) approval in order to bring the Soater's Outlet use into compliance <br />_ with the zoning ordinance. <br />_ 4.3 Although the Planning Commission unanimously supported the approval of the proposed <br />_ coNDiT1oNAL usE, the City Council was not entirely comfortable with the permanent <br />_ approval of the outdoor storage use in the Twin Lakes area. The coNDiT1oNAL usE <br />� application has since been withdrawn, and this INTExiM usE request has been submitted in <br />� its place to temporarily allow the storage of boats outside both for customers whose boats <br />are awaiting repairs and the seasonal storage of boats over the winter. <br />5.O INTERIM USE APPLICATIONS <br />� Section 1012.09 (Interim Uses) of the City Code establishes the regulations pertaining to <br />4 INTERIM USES. <br />� 5.1 Section 1012.09A states: The City Council may authorize an interim use of property. <br />� Interim uses may not be consistent with the land uses designated on the adopted Land <br />� Use Plan. They may also fail to meet all of the zoning standards established for the <br />� district within which it is located <br />F 5.2 Section 1012.095 states: The City Council may attach conditions to Interim Use Permits <br />F [sicJ. In reviewing [suchJ applications, the City will establish a specif c date or event <br />F that will terminate the use on the property. The Council will also determine that the <br />F approval of the interim use would not result in adverse effects on the public health, <br />F safety, and general welfare, and that it will not impose additional costs on the public ifit <br />F is necessary for the public to take the property in the future. <br />F 5.3 An applicant seeking approval of an INTExiM usE is required to hold an open house <br />F meeting to inform the surrounding property owners and other interested attendees of the <br />F proposal, to answer questions, and to solicit feedback. The open house was held on <br />F December 1, 2009; nobody attended the open house meeting. <br />E 6.O STAFF COMMENTS <br />E 6.1 Interim uses typically represent departures from what is allowed by the normal zoning <br />� requirements; although the current General Industrial (I-2) District allows outdoor <br />storage as a conditional use, the I-2 zoning appears to be in conflict with the Community <br />PF09-025_RCA_122109 (2).doc <br />Page 2 of 4 <br />
