I have had <br />recent discussions with the City Attorney about the city's ability to <br />participate in the repair cast of what city code defines as private <br />(service laterals}. He has stated and is providing a written opinion to <br />the effect that the Council does not have the authority to participate <br />in the repair of service laterals without changing the city code. <br />Changing the city code could have significant cost implications that <br />the Council would need to understand andconsider. We will know <br />in a few weeks whether the Council is interested in looking at code <br />channges. The current discussion was precipitated by a request for <br />participation in a collapsed service lateral under the concrete <br />pavement on County Road B. 1 can let you know if it looks like there <br />will be any changes but for now as staff 1 believe the LMCIT decision <br />to deny is what we are obligated to stand by. <br />There is no question your service is much shallower in the roadway <br />than the normal 7 feet of cover or more.
