From informatian pra�vided to mc on this matter I find as fokiows: <br />i. �i hc damage referred ta by Ms. Carpenter in bath 20�7 and in 20Qg was the result of a <br />fro�en sewer line. <br />2, There is a slight sag in lh� sewer line where it is belie�ed the blt�cka�e Qccurs. <br />3, The locat7c�n of'the sa� and the �locka�e in the sewer line is between Ms. Carpenier's <br />home and the main sewer line. This portion ❑f the line was constructed k�y a pri�ate <br />contractor. <br />4. A claim was pre�iously submitted to the I,�ag�e of Minnesota C:ity Claims <br />I)epartmcnt in 2007. "f'he in�estigation of the l�eague af Minn�sota City Insurance <br />'I�rust fcatinc� that the City o#� I�ose�ille was not res�aonsible for the bac.kup anc� th� <br />claim was denied. <br />5. Section 802.06 L2 of the Roseville City Code pra�vides as fallo�n�s: <br />"It shall b� the responsibility of the owner or occupant to maintain the sewer <br />servicc from the main scwer into the housc or building," <br />Sased upan the f«rc�c�ing I�ind that the blockage prablem is located in that portion of the scwer <br />line running irom Ms. Carpenter's hume to the main City sewer line. �lccording to City Code, <br />the awner �f'the praperty is responsible f'Ur maintaining and cleaning the sewer fine fram her <br />home ta the City's sewer main.
