6. COMPENSATORY ACTION: In lieu of enforcement proceedings, penalties, and remedies authorized by <br />this Ordinance, the City may impose upon a violator alternative compensatory action such as storm drain <br />stenciling, attendance at compliance workshops, creek cleanup, etc. <br />7. VIOLATIONS DEEMED A PUBLIC NUISANCE: In addition to the enforcement processes and <br />penalties provided, any condition caused or permitted to exist in violation of any of the provisions of this <br />Ordinance is a threat to public health, safety, and welfare, and is declared and deemed a nuisance, and <br />may be summarily abated or restored at the violator's expense, and/or a civil action to abate, enjoin, or <br />otherwise compel the cessation of such nuisance may be taken. <br />8. CRIMINAL PROSECUTION: A violation of this ordinance is a misdemeanor. <br />9. COSTS AND EXPENSES: The City may recover all attorney's fees, court costs, staff expenses, clean-up <br />costs, and any other expenses associated with enforcement of this ordinance including, but not limited to, <br />sampling and monitoring expenses. <br />10. REMEDIES NOT EXCLUSNE: The remedies listed in this ordinance are not exclusive of any other <br />remedies available under any applicable federal, state or local law and it is within the discretion of the <br />City to seek cumulative remedies. <br />SECTION 2: Title 5, Section 2.03 of the Roseville City Code is amended to read as follows: <br />502.03: OFFENSES INVOLVING PUBLIC HEALTH AND SAFETY: <br />A. Abandoned Ice Boxes: No person shall leave in a place accessible to children any abandoned, unattended or <br />discarded ice box, refrigerator or any other container of any kind which has an airtight snap lock or other <br />device without first removing the snap lock or doors from the ice box, refrigerator or container. (Ord. 244, 5- <br />10-58) <br />B. Dumping of Solid Waste: No person shall dump or deposit solid waste at any place within the City. (1995 <br />Code) <br />' ~ > <br />SECTION 3: Title 9, Section 5.03 E of the Roseville City Code is amended to read as follows: <br />905: Swimming Pools <br />905.03 Conditions <br />G. Backflush Water: to the extent feasible, backflush water or water from pool drainage shall be directed onto <br />the owner's property. ~;i~a..^~~^T° ~•~^z1^. Water shall not drain onto adjacent or <br />nearby private land. <br />SECTION 4: Effective date.
