Planning Commission Meeting <br />Minutes – Wednesday, October 07, 2009 <br />Page 3 <br />report related to screening and select areas allowed for display sales as identified in the <br />site plan. <br />Staff recommended approval of the request for a CONDITIONAL USE for RECO Real <br />Estate, LLC and Boater’s Outlet to allow the outdoor storage of boats at 1705 County <br />Road C; based on the comments and findings of Sections 4 and 5 and the conditions of <br />Section 6 of the staff report dated October 07, 2009. <br />Commissioners expressed concern with the status of the expired Interim Use Permit and <br />other potential expirations and how staff could monitor timelines for their expiration. <br />Staff noted that some Interim Use Permits were temporary in nature and had ceased; and <br />any remaining IUP’s were minimal in number (i.e., Meritex Trucking site); with others <br />subject to periodic review and renewal (i.e., multiple State Fair Park and Ride sites); <br />applicable legal issues for the City, with the applicant responsible in making application to <br />the City for any extensions; and no administrative extensions in place under current City <br />Code for the City to extend IUP’s. <br />Commissioners expressed concern that there was not a better process in place to monitor <br />those expired IUP’s, opining that this was not in the best interest of the City. <br />Staff assured Commissioners that there was newer computer technology now in place to <br />allow staff to maintain an up-to-date calendar system to allow tracking of land uses, <br />beyond institutional memory, and to avoid similar situations in the future. <br />Commissioners, by consensus, encouraged staff to maintain sufficient communication <br />with property owners and applicants that will provide monitoring of expiration dates. <br />Specific to this request, discussion included use of other portions of the site for outdoor <br />storage of school buses; staff’s identification of this as a pre-existing use, outside the <br />purview of this request, with no ability by the City to require additional standards (i.e., <br />screening) unless the property owner sought to make improvements on the lot; and <br />adjoining properties being industrial in nature, similar to the subject parcel, with Boaters <br />Outlet being one (1) tenant on the property. <br />Further discussion included type of storage exclusive to boats and boat trailers, but <br />excluding recreational vehicles and/or semi-trailer storage. <br />Mr. Lloyd advised that no applicant representatives were in attendance at tonight’s <br />meeting; and further advised that staff had received no written or verbal communication at <br />the staff level related to public notice of tonight’s hearing on this case. <br />With no one appearing to speak for or against, Chair Doherty closed the Public Hearing <br />for Case #09-025 at 7:45 p.m. <br />Commissioner Gisselquist observed, in driving by the property, that the other neighbors <br />were industrial users. <br />Commissioner Gottfried noted that the only potential issue would be the view from the <br />Byerly’s area; however, concurred that the subject property is in a commercial/industrial <br />area; and spoke in support of the motion. <br />Chair Doherty spoke in support of the request, as conditioned (Condition A of the staff <br />report) by staff related to screening. <br />Commissioner Wozniak spoke in support of the request; and provided contact information <br />for the applicant related to recycling of the plastic wrap materials through Genesis Poly <br />Recycling by phone at 763-553-2028. <br />Staff advised that they would forward that information to the applicant. <br />MOTION <br />Member Wozniak moved, seconded by Member Gisselquist to RECOMMEND TO <br />THE CITY COUNCIL APPROVAL a CONDITIONAL USE for RECO Real Estate, LLC <br />and Boater’s Outlet to allow the outdoor storage of boats at 1705 County Road C; <br /> <br />
