Authorize Sale of 1980 Caterpillar 140G Road Grader (Former Consent Item <br />7.h) <br />City Manager Bill Malinen briefly reviewed this item as detailed in the Request <br />for Council Action (RCA) dated February 8, 2010. Mr. Malinen advised that a$er <br />careful review by staff, it was being suggested that the fleet be reduced by this <br />one piece of equipment, based on the projected cost of repairs versus its actual <br />value. <br />Councilmember Ihlan clarified that this piece of equipment was going out of ser- <br />vice at this time, was to be replaced in the short-run, and then would be phased <br />out. Councilmember Ihlan sough assurance that purchase of the future equipment <br />would come before the City Council for approval as part of future budget discus- <br />sions. <br />Mr. Malinen advised that replacement of this equipment is planned to be the 2011 <br />purchase of a tandem truck chassis with a hook system allowing for multiple body <br />attachments. Mr. Malinen noted that, when the grader was purchased, the City <br />was performing much more street work itself than contracting it out. Mr. Malinen <br />assured Councilmember Ihlan that equipment purchases would be part of upcom- <br />ing budget discussions. <br />Roe moved, Ihlan seconded, authorizing the sale of the 1980 Caterpillar 140G <br />Road Grader. <br />Roll Call <br />Ayes: Johnson; Ihlan; Roe; and Klausing. <br />Nays: None. <br />d. Adopt a Resolution to Authorize Final Payment and Commence One-Year <br />Warranty Period on Rosewood Neighborhood Drainage Improvements Pro- <br />ject (Former Consent Item 7.1) <br />City Manager Bill Malinen briefly reviewed this item as detailed in the Request <br />for Council Action (RCA) dated February 8, 2010. <br />Mayor Klausing clarified that the City was proposing to terminate the contract <br />early based on our allegations that the provider has failed to fulfill their end of the <br />contract; however, he questioned whether the City would not be in breach of con- <br />tract by doing so. Mayor Klausing sought comment from the City Attorney and <br />additional information on discussions between the City and the provider. <br />City Attorney Charles Bartholdi advised that, to-date, his office had had no con- <br />tact with this individual; and shared Mayor Klausing's concerns, suggesting that it <br />
