Yppel <br />651.&{78.6620 <br />n�ippel ci�briggs.com <br />You have inquired about the legal authority of Housing and Redevelopment Authorities <br />to issLie bonds pursuant to Minnesota Statutes, Sections 4b9.001 through 469.047 (the "HRA <br />Law"). <br />Pursuant to the HRA Law Housing and Redevelopment Authorities ("HRA") are granted <br />�he powers to undertake rcdevelopment pz-ojects, hausing projects, and housing development <br />projects. A housing project is any wor�C or undertaking to provide decei�t, safe and saniiary <br />dwellii�gs for persons of low incame and their families. A housing development project is any <br />wark or undertaking to provide hausing for persons of moderaie income and their families. It is <br />E�ot necessary for a HRA to hold a public hearin� prior to undertakii�g a housing project or a <br />housing development project. A�edevelopment project means any work or undertaking (1} to <br />acquire blighted areas and o�her real property for the purpase of removing, preventing, or <br />reducing blight, blighting factors, or the causes of bliglit; (2) to clear any areas acquired and <br />install, constru�t or r�construct streets, utilities, and site improven�ents essen�ial to the <br />preparation of sites %r uses in accordance with the redevelopment plan; (3) to sell or lease lanci <br />so acquired for uses in accordance with the redevelopment plan; (�} to prepare a redevelopment <br />plan, and to incur initia#ion, planning, survey and other administrative costs of a redevelopment <br />project, and ta prepare technical and finar�cial plans and arrangements for buildings, structLires, <br />and improven�ents and all other work in connection therewith; or (5) to conduct an urban <br />renewal project. Prior to undertaking a redevelopment project, it is necessary for the city to <br />adopt a redevelopmei�t plan and before approving any redeve�opment plan, the city niust hold a <br />public hearing on the redevelopment plan at�er published notice is given not less than IO days <br />nor more tha�i 30 days prior to the date of the l�earing. <br />Pursuant to the authority granted in Miiinesota Statutes, Section �69.034 a HRA inay <br />issue bonds for any of its carporate purpases.
