comprises two additiona142-inch panel antennas and two 26-inch microwave dishes, all <br />of which will be mounted on the penthouse wall but not extend above its roof, along with <br />an equipment cabinet to be installed within the penthouse structure; all of this falls within <br />the exemption and is, therefore, permitted. <br />5.4 Section 1013.10A8 (Existing Facilities) further requires telecommunication facilities to <br />be "dismantled and removed from the site within one year" after the equipment is no <br />longer in use. Just as previous antennas have been removed from this site when the <br />equipment was no longer needed by the providers, Clearwire's equipment would also <br />have to be removed within a year of discontinuation of service at this location. <br />5.5 Section 1014.01 (Conditional Uses) of the City Code requires the Planning Commission <br />and City Council to consider the following criteria when reviewing a coN�iTioNaL usE <br />application: <br />• Impact on traffic; <br />• Impact on parks, streets, and other public facilities; <br />• Compatibility of the site plan, internal traffic circulation, landscaping, and <br />structures with contiguous properties; <br />• Impact of the use on the market value of contiguous properties; <br />• Impact on the general public health, safety, and welfare; and <br />• Compatibility with the City's Comprehensive Plan. <br />a. Impact on trafiic: Planning Division staff has determined that an increase in <br />traffic volume due to the presence of the proposed antennas will not be an issue <br />given that such a facility is not the origin or destination of vehicle trips beyond <br />the initial installation and occasional maintenance. <br />b. Impact on parks, streets and other public facilities: Planning Division staff has <br />determined that the only potential impact of telecommunications antennas on the <br />City's parks, streets, and/or other facilities would be aesthetic (i.e., as viewed <br />from locations outside of the subject property) and that the proposed installation <br />will be almost unnoticeable among the existing equipment. <br />c. Compatibility ... with contiguous properties: The proposed building-mounted <br />antennas would not change the circulation on the property, and no changes are <br />proposed to the site plan, landscaping, or building which would affect <br />compatibility with contiguous properties. <br />d. Impact of the use on the market value of contiguous properties: Planning <br />Division staff is unaware of existing market analyses indicating that antennas like <br />those currently proposed have negative impacts on the market value of nearby <br />properties, especially when much larger antennas are presently on the same <br />building. <br />e. Impact on the general public health, safety, and welfare: Planning Division <br />staff is unaware of any negative impacts on the general public health, safety, and <br />welfare caused by the provision of wireless Internet service as proposed. <br />Moreover, the Federal Communications Commission, which is the regulating <br />PF10-007 RCA_032210 (3).doc <br />Page 3 of 6 <br />
