<br />TNHEREAS, on December 20, 1955, the Village Council of Roseville, State
<br />of Minnesota, did, by a Resolution duly adopted, grant to the Roseville Water
<br />Company, Inc., its successors and assigns the right, permission, franchise and
<br />license to install and maintain water pipes in streets right-of-way in certain
<br />areas, and,
<br />
<br />itlHERF....AS, the Village Council of Roseville did, on the 16th day of September,
<br />1958, extend the terms of said original franchise, and,
<br />
<br />vJHEREAS, the Roseville Water Company, Inc. has requested permission of the
<br />Village of Roseville to install and maintain underground water pipes in certain
<br />additional areas within said Village,
<br />
<br />NO\v, TT1E REF ORE , BE IT RESOLVED, by the Village Council of Roseville,
<br />Minnesota, ~hat the Roseville Water Company, Inc. its successors and assigns,
<br />be granted the right, permission, franchise and license to install and maintain
<br />water pipes in the presently dedicated streets rights-of-way and in all streets
<br />rights-of-way which may hereafter be laid out, platted and dedicated, in the
<br />area or areas hereinafter described, to-wit:
<br />
<br />A tract of land bounded on the North by Ramsey County Road IIDIt; on the South
<br />by the Northern Pacific Railroad right-of-way and Ramsey County Road IIC"; on the
<br />West by Lexington Avenue; and on the East by Dale Street more particularly described
<br />as follows:

<br />BEING THE POINT OF BEGINNING.

<br />BE IT FURTHER RESOLVED, that the foregoing Resolution is subject to the
<br />acceptance by the Roseville 'VTater Company, Inc., of the modifications and
<br />amendments hereinafter stated, within ten (10) days after the passage of this
<br />Resolution, otherwise the same shall be null and void; that upon said acceptance,
<br />the rights, privileges, license and franchises hereby granted shall be subject
<br />to all of the terms, conditions and obligations as set forth in the former
<br />Resolutions as CIDlended herein.

<br />The said Resolution dated December 20, 1955, and September 16, 1958, are
<br />amended as follows:
<br />
<br />(a) The \^/ater Company shall erect without cost to the Village 511 x 7'
<br />fire hydrants with frost jacket, or equivalent, at such points and places in
<br />the w'ater works system as recommended and approved by the Board of Fire Under-
<br />writers. If ordered by the Village Council, the company shall erect additional
<br />hydrants but the full cost of erecting the same shall be borne by the Village or
<br />by the person to be benefitted thereby and satisfactor.y financial arrangements
<br />shall be made to reimburse the company therefore before it need erect the same.
