Roseville Public Works, Environment and
Transportation Commission
Agenda Item
Date: November 24, 2008
Item No: 5
Item Description: Pond/ Ditch Maintenance Regulation Update
The MPCA has specific and detailed protocols for dealing with dredged materials. These
protocols were not written with storm water ponds in mind. Following the protocols for testing
and disposing of contaminated dredged materials can result in making a storm water pond
dredging project very expensive. For more information you can go to the MPCA site:
http://www.pca.state.mn.us/water/dredgedmaterials.httnl
The MPCA has begun the work effort to reissue the expired general permit for the management
of dredged materials (MNG990000); a preliminary permit has been drafted. The MPCA will
soon be requesting input from representatives from public and private organizations involved in
dredging activities to further clarify the scope of the permit, including work on further defining
projects that do (and do not) need a permit, as well as the consolidation of construction storm
water standards into the General permit. Here is the schedule posted on their webpage:
Task Date(s)
Develop permit ` Begin July 2005 ~,
Review of permit (internal and external), respond to ~
comments (stakeholder meetings) Fall 2007 - Fa11200~ ~
Publish public notice of draft permit I Fa112008
Respond to comments and finalize permit
• no hearing request
• with hearing request
• .., 3 - h months after public notice
• ~ 10 months after public notice
MPCA Citizens' Board decision on permit ,
__ Spring -Fall 2009
f
Permit reissued ' Fall 2009
We have been strongly advised by the Minnesota Cities Stormwater Coalition to hold off on any
stormwater pond dredging projects until the MPCA has revised their permit.
Recommended Action:
Discuss regulations
