REQUEST FOR HRA ACTION <br />Date: 1-17-06 <br />Item No: <br />Staff Approval: Agenda Section: <br />C B/DW PUBLIC HEARING <br />Item Description: Public Hearing for new Ci ty Code Sections 907 (Residential Rental <br />Property Licensing and Inspection for 1 to 4 units) (HF36) <br /> <br />1.0 Requested Action: <br />1.1 Hold Public Hearing and take public testimony regarding Licensing and Inspection of <br />Residential Rental Property of 1 to 4 units – Proposed City Code Section 907 <br />1.2 Upon conclusion of public hearing make a r ecommendation regarding the proposed rental <br />licensing ordinance for City Council consideration and adoption in February. <br />2.0 Background on Process: <br />2.1 The Roseville City Council held a public hearing on November 28, 2005 regarding the <br />proposed rental ordinance (Proposed City Code Section 907) as well as a Property <br />Maintenance Code (Proposed City Code Section 907). Of the 382 mailed notices sent <br />regarding these proposed code sections - 16 total comments were received,4 wanted more <br />regulation and were in support, 2 had general questions, and 10 were opposed to the <br />additional ordinances.Of those 10, 4 were dupl ex owners who live in one side of the <br />property. <br />2.2 Based upon the comments and questions at the public hearing, staff prepared a summary <br />with responses to each question and suggestion. (Attachment A) <br />2.3 The City Council did not take action at the N ovember 28, 2005 meeting but rather asked that <br />the HRA hold an additional public hearing on Ja nuary 17, 2006 to consider modifications to <br />the ordinance based upon the comments recei ved. The City Council will consider the <br />adoption of a Property Maintenance Code, independe nt of a Rental Ordina nce, at the January <br />30, 2006 Council meeting after further discussion and review at the January 23, 2006 work <br />session. <br />2.4 In addition, the City Council asked that staff review the new City of Burnsville Ordinance <br />and consider if components of this ordinance can be incorporated into Roseville’s proposed <br />Ordinance. A summary of the Burnsville Ordina nce is attached along with HRA and City of <br />Roseville staff comments on this type of ordinance (Attachment C ). <br />3.0 Why Consider a Rental Ordinance? <br /> <br />3.1 During the past ten years, at the Council’s request, the HRA, Planning Commission and <br />staff have reviewed the needs for and suggested new tools to retain value in the city's <br />housing stock. Options reviewed include adop tion of a Property Maintenance Code (for <br />all properties and buildings within the City) and in addition (more recently) a Rental <br />Licensing Code (for structures with up to 4 units). <br /> <br /> RHRA_ Rental Licensing & Property Maintenance Public Hearing (01-17-06) - Page 1 of 6
