1 <br />Section 907.12. Rental Appeals Board. <br />The Rental Appeals Board is hereby designated to act as an <br />2 <br />advisory body. The Board shall consist of the Board of the Roseville HRA. The Board shall hear appeals <br />3 <br />arising from a correction order and make recommendations to the City Council to affirm, modify or <br />4 <br />reverse, in whole or in part, such order. This Board shall also review and approve administrative policies <br />5 <br />and procedures pursuant to this ordinance, and regularly review and make such recommendations, as the <br />6 <br />Board deems reasonable and necessary to the City Council as to the annual schedules of fees and <br />7 <br />penalties required under this Title. <br />8 <br />9 <br />Section 907.13. Appeal Process. <br /> When it is alleged by any person to whom a correction order is <br />10 <br />directed that such order is based upon erroneous interpretation of the applicable rules, standards, statutes <br />11 <br />or ordinance or mistake in fact, such person may appeal the correction order to the Rental Appeals Board. <br />12 <br />13 <br />Such appeal must be in writing, must specify the grounds for the appeal, must be accompanied by any <br />14 <br />filing fee set by Council resolution, and must be filed within five (5) business days after service of the <br />15 <br />correction order. Upon receipt of the written appeal, the HRA shall set a date for a hearing and give the <br />16 <br />appellant at least five (5) days prior written notice of the date, time and place of the hearing. By mutual <br />17 <br />agreement between the appellant and the HRA Director, the five (5) day notice may be waived. <br />18 <br />19 <br />The appellant shall have the right to appear and be represented by counsel. The Rental Appeals Board <br />20 <br />shall hear and consider the matter within thirty-days (30) of the filing of an appeal. The filing of an <br />21 <br />appeal shall stay all proceedings in furtherance of the action appealed from unless the enforcement officer <br />22 <br />certifies that such a stay would cause imminent peril to life, health, or property. <br />23 <br />24 <br />The Rental Appeals Board shall issue its recommendation to the City Council and the appellant in writing <br />25 <br />within thirty-days (30) after the hearing. The City Council shall thereafter affirm, modify or reverse the <br />26 <br />correction order upon such terms as the City Council deems necessary to accomplish the purposes of this <br />27 <br />ordinance. A copy of the decision shall be mailed to the appellant. <br />28 <br />29 <br />Section 907.14. Authority. <br />Nothing in this Section shall prevent the City from taking action under any <br />30 <br />applicable rule, standard, statute or ordinance for violations thereof to seek either injunctive relief or <br />31 <br />criminal prosecution for such violations as therein provided. Nothing contained in this Section shall <br />32 <br />prevent the City from seeking injunctive relief against a property owner or designated agent who fails to <br />33 <br />comply with the terms and conditions of this Section on registration and licensing including an order <br />34 <br />prohibiting the occupancy of such rental units until violations of this Section have been remedied by the <br />35 <br />property owner or designated agent. COMMENT: SHOULD THIS BE THE CITY OR HRA <br />36 <br />REFERENCE? <br />37 <br />38 <br />Section 907.15. Posting. <br />Every licensee of residential rental property shall conspicuously post a <br />39 <br />receipted copy of the current license (in a frame with transparent cover) in such a manner so as to be <br />40 <br />easily viewed and readable at or near the front entrance of the building for which it was issued. <br />41 <br />42 <br />Section 907.16. Inspection Access. <br /> Property owners and their agents shall permit, during regular <br />43 <br />business hours, the enforcement officer to inspect all premises governed by this Section to determine if <br />44 <br />the building is operated as a rental property and/or to determine compliance with the provisions of this <br />45 <br />section, and shall fully cooperate with such inspections. The property owners or their agents shall make <br />46 <br />reasonable efforts to notify tenants of planned inspections of their rental units to the extent required by <br />47 <br />state law. <br />48 <br />4 <br /> <br />
