Casserly, Esq. <br /> Krass Monroe <br />Date: April 12, 2004 <br />Re: Wu Eminent Domain Proceeding <br />Our File No. 11637-3 <br />The purpose of this memorandum is to give you and the HRA Board members an <br />overview of the eminent domain process. <br />Statutory Authority <br /> Minn. Stat. Section 469.012, subd. 6 gives the HRA the ability to acquire property by <br />eminent domain, provided that the HRA adopts a resolution which states that the acquisition is <br />necessary to eliminate one or more of the conditions which were found to exist in the City at the <br />time the resolution contemplated by Section 469.003 was adopted by the HRA (this is the HRA’s <br />enabling resolution). Such conditions can include substandard, slum, or blighted areas, as in the <br />case of the Wu property. <br />Process <br /> It is assumed that the HRA will use the “quick take” proceeding pursuant to Section <br />469.042, which allows the HRA to take title and possession of the Wu property before the <br />amount of the award has been determined.
