Casserly, Esq. <br />Date: July 8, 2004 <br />Re: Wu Condemnation/Structurally Substandard Resolutions <br />Our File No. 11637-3 <br /> Attached you will find a resolution for the HRA and a resolution for the City which declare <br />your intent to include the Wu parcel, with its structurally substandard building, in a tax increment <br />financing district. Note that adoption of these resolutions does not obligate the HRA and the City to <br />create a district or to include the Wu parcel in a district, but rather merely preserves the status of the <br />parcel for purposes of qualification for inclusion in a district. <br /> The Tax Increment Act permits a municipality to demolish a substandard building on a <br />parcel, and yet have the parcel be deemed to still contain the substandard building for purposes <br />of qualifying the parcel for future inclusion in a redevelopment tax increment financing district, <br />as long as the requirements of Minnesota Statutes, Section 469.174, Subd. 10(d) are met.
