<br />~ <br /> <br />GJO?~~ATIVE FIRE AND EMERGENCY SERVICE AGREEMENT <br /> <br />Th", undersigned municipal officials, acting pursuant to Minnesota Statutes <br />Sections 412.221, 471.59, 438.08, and 438.09 and as authorized by resolution of <br />their respective councils, do hereby enter into this agreement providing a <br />cooperative procedure for the handling of fires and other emergencies. <br />In consideration of the mutual public benefits which result from a cooperative <br />effort, the parties agree to furnish fire fighting equipment and personnel to any <br />of the others ~en called upon by the fire chief or fire department officer in <br />charge to assist in the handling of an emergency beyond the scope and capacity of <br />the men and equip~nt of the individual municipality, subject to the following <br />condi tions: <br />1. Travel and weather conditions must be such that, in the opinion of <br />the fire chief, or department officer in charge, the assistance can be made avail- <br />able with reasonable safety to men and equipment. <br />2. In the event the personnel and equipment of the fire department of <br />any municipality are employed at the time the call for assistance is received <br />from another-municipality, or when in the opinion of the fire chief, the personnel <br />and equipment are needed in the community, said municipality shall be held free <br />and relieved from all responsibility to respond to the call for assistance. <br />3. In the event any equipment or personnel of any municipality responding <br />to a request for assistance shall be needed for any purpose in its own municipality, <br />the equipment and the personnel of said fire department may be recalled to its own <br />municipality before completing the fire fighting or other assistance for the other <br />party and said assisting party shall be held free from any responsibility to continue <br />to render assistance. <br />4. The fire chief or depaptment officer in charge shall decide whether to <br />supply the amount and tYJ:!! of equipment or personnel which will respond to a request <br />for assistance. The decision and discretion of the fire chief or other department <br />officer in charge shall be final in such matter and no party shall be liable to any <br />other party or to any other person, firm or corporation for failure of the department <br />of said party to answer a call for assistance or for any damage to or loss of goods <br />.~r for any act, omission, or for any other reason. <br />5. The municipality asking and receiving assistance from any other party <br />hereto shall not be held liable for any damage to the property of the assisting <br />party while answering the call fot assistqnce or while in the service of the community <br />requesting assistance; each party shall carry its own liability insurance for the <br />benefit of itsolf, its equipment and its firemen while in the service of any other <br />party and each party shall carry liability insurance saving both itself and the <br />other party being assisted harmless so far a,!,~f)'y' ~e~1jQent, acts of the firoment in <br />
