PAUL, MN 55106 <br />FILE NO. <br />Brad Oren <br />375 South Owasso Blvd. <br />Roseville, MN 55113 <br />Mr. Oren: <br />RE: REPLACEMENT OF BOATHOUSE FOUNDATION <br />Enclosed are copies of Minnesota Rules 6115.0200 through 6115.0211. <br />These rules are the basis for the issuance/denial of Protected <br />Waters Permits for excavation and structures in protected waters. <br />As per our conversation on July 28, 1994, the DNR would likely deny <br />a permit for the replacement of the foundation to the boathouse. <br />This denial would be based, in part, on the following sections: <br />oe <br />1. MR 6115.0210 Subp. ic. encourage the removal of existing <br />structures which do not serve the public interest from the <br />beds of protected waters at the earliest practicable date.11 <br />2. In order to issue a permit several conditions must be met <br />(see Minnesota Rule 6115.0211 Subp. 7). At least two of the <br />required conditions may apply; <br />(2) the cost of the work will not exceed 50 percent of <br />the replacement cost of the structure; <br />(3) the degree of permanence of the structure will not <br />be materially increased by virtue of constructing a new <br />foundation or replacing the majority of the structure <br />above the foundation;10 . <br />It is preferable that the boathouse be removed and the shoreline be <br />restored. An alternative to complete removal would be to remove <br />the existing foundation and restore the lakeshore while moving the <br />above foundation structure back from the waters edge to the setback <br />allowable in the City of Roseville's Shoreland Ordinance (a minimum <br />of 10' is suggested). Boat access may be allowed by a rail <br />system.
