(In all counties, not <br />just those with more than 80 percent of wetlands <br />remaining.) <br />*etland Planning <br />The bill would have allowed wetlands to be <br />classified based on function to: <br />-vary the application of sequencing standards; <br />-vary wetland replacement standards based on a <br />functional assessment; and then <br />•replace wetlands at less than <br />a 1 acre for 1 acre ratio, pro- <br />~vided that there was no net <br />loss of public values and bio- <br />logical diversity within the plan <br />area; <br />•allow additional replacement <br />credit for any project that in- <br />creased the public value of <br />wetlands, including those <br />activities on adjacent uplands; <br />and <br />-vary wetland exemption standards based on a <br />functional assessment; and then <br />•adjust the application of the <br />type 1 and type 2/6 exemptions <br />to non-ag land; <br />•adjust the road and deminimus <br />exemptions to reflect regional <br />conditions. <br />*Sequencing <br />-The bill would have provided for determination <br />without written alternatives analysis for small <br />projects impacting less than 20,000 square feet. <br />(In all counties, not just the counties with greater <br />than 80 percent of their wetlands remaining.) <br />ildlife Habitat Improvement <br />-The bill would have exempted deposition of <br />one-half acre of spoil resulting from excavation <br />within a wetland for wildlife habitat improvement <br />purposes. (In all counties, not just. those with <br />greater than 80 percent of their wetlands <br />remaining.) <br />AGRICULTURAL ACTIVITIES <br />The bill would have: <br />*defined agricultural land more broadly as: <br />(1) land used for horticultural, row, close grown, <br />pasture, and hayland crops; growing nursery <br />stocks; and animal feedlots; and <br />(2) contiguous land and buildings under the <br />same ownership, including farmyards, associated <br />with the lands listed in clause (1). <br />*exempted type 6 wetlands less than two acres <br />on ag land. <br />*exempted type 1, type 2 and type 6 parts of <br />larger wetlands on ag land (as per an approved <br />conservation plan) to allow for efficient farming <br />operations. <br />*allowed replacement credit for vegetative <br />restoration of farmed wetlands. <br />*allowed replacement credit for maintaining <br />wetlands restored under an expiring <br />conservation agreement. <br />SMALL LANDOWNERS & DEVELOPERS <br />*Deminimus. <br />-The bill would have exempted the following <br />amounts of wetlands as part of a project, that are <br />not type 3, 4, or 5, regardless of the total amount <br />of wetlands filled as part of a project: <br />(i) 10,000 square feet outside of shoreland <br />wetland protection zones in counties or <br />watersheds with more than 80 percent of their <br />presettlement wetlands remaining; <br />(ii) 5,000 square feet of wetland outside of <br />shoreland wetland protection zones in counties <br />or watersheds with more than 50 percent and <br />less than 80 percent of their presettlement <br />wetlands remaining; <br />(iii) 2,000 square feet of wetland outside of <br />shoreland wetland protection zones in counties <br />or watersheds with less than 50 percent of their <br />presettlement wetlands remaining; or <br />(iv) 400 square feet of wetland in shoreland <br />wetland protection zones, except that in counties <br />with greater than 80 percent of their <br />presettlement wetlands remaining, the local <br />government would have been able to increase <br />the deminimus amount to 1000 square feet in the <br />2 <br />
