This eliminates the <br />requirement that the effective dates for all plans <br />end in a year divisible by five (such as 1995, <br />2000, etc. ) <br />The law allows counties to request up to a two- <br />year extension on their existing water plan. <br />Requests will have to be in writing from the <br />county and received by BWSR before December <br />31, 1995, for current plans. <br />The law adds the requirements. that the water <br />plans include objectives for stormwater <br />management for developing areas. This was <br />added because of the repeal of the previous <br />stormwater requirements to 11II.S. 1036.3365. <br />Local Water Resources Protection and <br />Management Program (M.S. 1036.3365) <br />Changes in the law provide for a minimum base <br />grant of $18,750 for all counties regardless of tax <br />capacity. Previously, 10 counties had a high <br />enough tax capacity that they received no grant <br />through the program. This will not reduce any <br />allocation to another county. <br />r a <br />r nition ( )Chan <br />( .103 ) <br />Miscellaneous changes <br />The following changes were made regarding <br />watershed management organizations: <br />•The Minnesota Department of Agriculture will <br />now review metro water management plans. <br />•The plan review process now provides for a <br />concurrent 60-day review process by all the state <br />agencies. <br />•The WMO must hold a public hearing on a draft <br />plan no sooner than 30 and no later than 45 <br />days after the 60-day review period. <br />•The state review agencies will have a 45-day <br />period to review the changes to the draft plan <br />that result from the review of the draft and the <br />input from public meetings. <br />•The law was revised to clarify that an ad <br />valorem tax authorized for projects identified in a <br />plan could also be used for the cost of preparing <br />a plan. <br />•The law was revised to clarify that a joint powers <br />WMO can levy taxes to accomplish its purposes <br />and implement its plan as long as the joint <br />powers agreement includes that authority. <br />odel second generation plans <br />The Metropolitan Council has awarded a grant to <br />BWSR. to develop two model second generation <br />WMO plans. The BWSR intends to develop one <br />for a primarily rural WMO and one for a WMO in <br />the developing urban fringe. <br />Development of a O plan priority schedule <br />The law changes require that BWSR develop a <br />schedule for when different WMOs must have <br />their second generation plans completed. The list <br />must be prioritized. Under the law, if a WMO <br />submits a plan prior to the scheduled time and <br />the BWSR. fails to adjust its schedule, the plan is <br />approved by default. <br />Grants awarded directly to Os <br />The law now allows BWSR to award grants <br />directly to WMOs (including planning grants). <br />
