sions with local water planners, <br />facilities, resource managers, <br />and others in conjunction with <br />the response training in order to <br />foster cooperative spill-preven- <br />tion and preparedness. <br />Field ci tion authority for <br />sp. <br />I3esi ACA staff and <br />conservation officers are <br />authorized to issue f eld cita- <br />tions for violations of spill <br />reporting or cleanup require- <br />ments under iVI.S. 115.061, <br />spill prevention or prepared- <br />ness requirements under Chap- <br />ter 115E (Spill Bill), or the new <br />above ground storage tank rule. <br />The citations may be written <br />for a maximum of 52,000 per <br />violation type. <br />~1C ~C ~ 3 <br />Local unit of Bove anent <br />le petition <br />This legislation permits a unit <br />of local government to petition <br />a state agency for amendment <br />or repeal of a rule if the peti- <br />tioner shows that since the rule <br />was adopted there is significant <br />new evidence relating to need <br />for or reasonableness of the <br />Hale or to a less costly or <br />intrusive method of achieving <br />the purse of the rule. If the <br />agency does not take the action <br />requested in the petition, an <br />' 'strative law judge (AI..J) <br />will conduct a hearing, at <br />which the agency must show <br />the continued need for and <br />reasonableness of the rule. If <br />the ALJ determines the agency <br />has not made this showing, the <br />rule ceases to have the force of <br />law in 90 days.
