Page 4 <br />May 1, 2001 <br />• New roads and improvements to existing roads primarily for increased capacity <br />(see Question 2). <br />• Wetlands mined to secure road-building material. <br />• Projects relating to the expansion of airport facilities and runways. <br />• Projects related to the improvement of local road authority facilities such as <br />garages and salt storage sites. <br />If a local road authority is uncertain about whether the program will replace wetland <br />impacts, the matter should be brought to the attention of a TEP member (see Question <br />#7)even before the Public Road Combined Project Application Form is submitted. <br />Question 7: What authority does the Technical Evaluation Panel-(TEP) or others who receive <br />notice have? <br />Answer 7: Members of the TEP and persons and agencies who are required to receive notice of a <br />project may appeal minimization, delineation, and on-site mitigation decisions of the <br />road authority (see Mn Rule 8420.0540, Subp. 5, F.}. Therefore, it is important that <br />local road authorities attempt to minimize impacts and consider on-site mitigation before <br />applying to BWSR for replacement. <br />Question 8: Will the BWSR be required to replace wetland impacts caused by qualifying <br />1~.RRRR Projects if the legislature doesn't fund the program? <br />Answer 8: No, implementation ofthis program is subject to the legislature providing the funding. <br />If no more funding is provided, we will assign all wetland credits we've established or <br />are under develcp~r~ent to projects that have been reported to us on afirst-come, first- <br />serve basis. The BWSR is working with county, city, and township associations to <br />secure stable funding for the program this legislative session. If you support the <br />program, you should contact your legislators and affiliation organization and ask them to <br />support stable funding. <br />Question 9: Will the BWSR pay for on-site mitigation if required by the LGU or another <br />regulatory agency such as the MDNR or Corps of Engineers? <br />Answer 9: No. <br />
