BWSR Meeting Minutes <br />December 19, 2001 <br />Page Five <br />Another appeal involves a matter that was previously appealed in McLeod County. <br />Under remand, the county held a public hearing and made the same decision that the <br />county staff person had previously made, which was approval of an agricultural <br />exemption. No decision has been made on accepting the appeal. <br />Another appeal is of an exemption determination in Blue Earth County. The appeal <br />involves JD 1. The appeal involves wetlands that have been in existence more than 25 <br />years and possibly some DNR protected waters. The appeal was remanded for a public <br />hearing and more technical analysis. <br />Another appeal is of a replacement plan denial in Stearn's County. The appeal involves <br />a single family dwelling site near the Mississippi River. The appeal has been accepted <br />and is being held in abeyance since the landowner is exploring his options with the <br />county. <br />Another appeal was recently filed involving the Lent wetland banking site in Chisago <br />County. The project was started about. four years ago. Both the TEP and the Corps <br />have determined none of the site is eligible to be placed in the wetland bank yet. The <br />appeal has been accepted and is being held in abeyance to see how the site looks this <br />spring. <br />There is an appeal of a no-loss decision in Mower County. It involves Lansing Landfill. <br />The appeal was remanded. The Mower SWCD Board heard the matter, made the same <br />decision, and now the landowner plans to appeal again. <br />Two other pending appeals involve the same exemption determination by the Rice <br />Creek Watershed District involving JD2 by Hugo. The appeals have been accepted, a <br />prehearing conference was held Nov. 27, the briefing schedule starts after the first of <br />the year, and a hearing is scheduled before the DRC on Feb. 6. <br />Another pending appeal is in LaCrescent along the Mississippi River in Houston <br />County. The replacement plan denial by the county arose from a cease and desist <br />order and a restoration order.. The appeal has been accepted and at the pre-hearing <br />conference resolution was explored. The appeal is pending while discussions occur <br />with the landowner, the city and the county, mostly regarding flood control. <br />Cost-Share/Soil Conservation Committee -Dwain reported that he attended the <br />MAWD and MASWCD annual conventions. Some items addressed at the MASWCD <br />annual convention will come before the cost-share committee. <br />
