Date: 04/22/04 Prepared by: Mark Maloney Item: D-3 <br />Other Business <br />Item Description: Amended Joint Powers Agreement <br />The :Grass Lake Water Management Organization was initially established and empowered <br />through a Joint Powers Agreement (JPA) between the .Cities of Shoreview and Roseville in 1983. <br />That agreement reflected then current State Statutes and agency rules, and identified various <br />operating parameters for the WMO. The 2001 Surface Water Management Plan for GLWMO <br />:identified an update of the original JPA as a fairly high priority; staff has reviewed the JPA with <br />Shoreview's legal counsel and identified a number of areas requiring review. The attached draft <br />agreement contains detailed amendments in the following areas: <br />Statutory References <br />There have been considerable changes in the laws concerning. Water Management Organizations <br />since 1983. All of the State Statutes referred to in the original JPA have been repealed, <br />reorganized and rewritten in Minnesota Statutes Chapter 103B. <br />Minnesota Rules Chapter 8410 <br />.The Board of Soil and Water Resources has specific rules concerning the content of joint powers <br />agreements for the creation and operation of water management organizations. The JPA has .been <br />revised to reflect the organization and requirements of MN Rules 8410. <br />OperationaUMiscellaneous Issues <br />There are numerous relatively minor revisions that reflect the way the Board has conducted its <br />business since the early 1990's, for example, .the election of officers, voting requirements, <br />meeting schedule (quarterly instead of monthly), and budgeting. <br />Staff has prepared a draft of the amended joint powers agreement that attempts to meet the <br />minimum requirements of the applicable-State laws and rules, and incorporates the GLWMO <br />operational practices that have evolved since it's creation in 1983. The Board should review and <br />comment on the proposed draft agreement, and request that it be forwarded on to Roseville, <br />Shoreview, and the Board of Soil and Water Resources for review and comment. It is a realistic <br />goal to have the amended JPA executed and in effect within 90 days. <br />
