BOARD OF WATER COMMISSIONERS RESOLUTION -GENERAL FORM PRESENTED BY COMMISSIONER No 4982. DATE WHEREAS, high water levels at West Vadnais Lake have caused flooding problems at the Board of Water Commissioners' Vadnais Pumping Station and Ramsey County's roadway on Rice Street in Vadnais Heights; and WHEREAS, the Minnesota Department of Transportation (MnDOT) plans to reconstruct I-694 east of Rice St, beginning in 2005, providing a unique opportunity for construction of a new outlet for West Vadnais Lake under I-694; and WHEREAS, MnDOT is willing to provide for the construction of said outlet as part of its I-694 reconstruction project at an estimated cost of $99,966; and WHEREAS, the benefiting and responsible parties, Ramsey County ("County"), Vadnais Lake Area Water Management Organization ("VLAWMO"), Grass Lake Water Management Organization ("GLWMO"), and Ramsey Washington Metro Watershed District ("District"), (collectively, the "Parties") discussed the project impacts and recommended cost sharing distributions based on benefits to the Parties; and WHEREAS, the County prepared a cooperative agreement between the Parties that established those cost sharing distributions, and the Board did approve said agreement by adoption of Resolution No. 4975; and WHEREAS, VLAWMO denied approval of said agreement, requiring the preparation of an agreement which does not include VLAWMO, nor its contribution; and WHEREAS, the County prepared such an agreement, which reflects the following contributions, based on benefit to the parties, and other such terms and conditions necessary to administer the funding distribution: Construction Costs: Board (33.30%) County (50.00%) [from MnDOT Turn Back funds] GLWMO (16.70%) District - 0 - (no benef tl Total (100.00%) Water Commissioners Yeas Nays Adopted by the Board of Water Commissioners 20 - In favor.
