The City of Roseville is the a. ~ Local Governmental Unit (LGU) responsible for implementation of the ~- - WCA in the project area. However, most if not all of the proposed wetland g impacts are below the OHW a-~d the City of Roseville has elected to waive their jurisdiction to the MNDNR. r 4.5 Sequencing 4.5.1 Avoidance and Minimization m Impacts to wetlands from the roadway and trail construction have been. avoided and minimized to the maximum extent feasible as described above. Impacts to Wetland 2 will be minimized to 914 square feet for construction ,~ of the realigned roadway and the adjacent pedestrian trail. Avoidance of impacts to Wetland 1 is not practical. However, the design provides for pretreatment of runoff to be accomplished in Cell 1 (constructed -" in upland area) to the greatest extent possible. Construction of the secondary treatment cells (Cell 2 and Cell 3) will be within the wetland area and below the OHW, but the impact area has been located within the area of the existing -~ channel to the greatest extent possible. This effort makes use of the current function. of the channel as a storm water conveyance but expands the facility to provide more effective and maintainable treatment of urban runoff prior to -i discharge into the adjacent wetland area. 4.5.2 Wetland Impacts The area of unavoidable wetland impact is limited to 0.02 acres (914 square feet) of fill in Wetland 2 and 0.91 acres of excavation of the two secondary treatment cells in Wetland 1. The areas of impact are shown on the project plans in Figure 4. All of the fill impact is in Wetland 2 under jurisdiction of the WCA and the USACE and all excavation impact is within the large complex of Wetland 1 under the jurisdiction of the MNDNR and the USACE. 4.6 Permitting It is acknowledged that permits for excavation of the ponds within the -! wetland are required by the MNDNR, and the USACE. A permit for filling for the roadway is required by the WCA and USACE. The following paragraphs describe the permits requested by this Wetland Permit _ ± Application.. 4.6.1 Wetland Conservation Act -City of Roseville The City of Roseville is responsible for administration of the WCA in the project area. However, because all of the impacts from the pond construction will occur in MNDNR Protected Water Wetland 62-137W, all of the excavation. impacts to that wetland are outside of the jurisdiction of the WCA and are under the jurisdiction of the MNDNR and the USACE_ The proposed fill in Wetland 2 is outside of the jurisdiction of the MNDNR and therefore under the jurisdiction of the City of Roseville and the WCA. The proposed 0.02 acres of fill will require replacement in accordance with the rules of the WCA.
