<br />~_ _ <br />Owasso and Wetland. 1, or by connection (culvert connection to Wetland 2). <br />`~- The MNDNR is responsible for the area of Wetland 1 (62-137W) below the <br />ordinary high water (OHW) elevation of 887.1. The City of Roseville is the <br />a. ~ Local Governmental Unit (LGU) responsible for implementation of the <br />~- - WCA in the project area. However, most if not all of the proposed wetland <br />g impacts are below the OHW a-~d the City of Roseville has elected to waive <br />their jurisdiction to the MNDNR. <br />r 4.5 Sequencing <br />4.5.1 Avoidance and Minimization <br />m Impacts to wetlands from the roadway and trail construction have been. <br />avoided and minimized to the maximum extent feasible as described above. <br />Impacts to Wetland 2 will be minimized to 914 square feet for construction <br />,~ of the realigned roadway and the adjacent pedestrian trail. <br />Avoidance of impacts to Wetland 1 is not practical. However, the design <br />provides for pretreatment of runoff to be accomplished in Cell 1 (constructed <br />-" in upland area) to the greatest extent possible. Construction of the secondary <br />treatment cells (Cell 2 and Cell 3) will be within the wetland area and below <br />the OHW, but the impact area has been located within the area of the existing <br />-~ channel to the greatest extent possible. This effort makes use of the current <br />function. of the channel as a storm water conveyance but expands the facility <br />to provide more effective and maintainable treatment of urban runoff prior to <br />-i discharge into the adjacent wetland area. <br />4.5.2 Wetland Impacts <br />The area of unavoidable wetland impact is limited to 0.02 acres (914 square <br />feet) of fill in Wetland 2 and 0.91 acres of excavation of the two secondary <br />treatment cells in Wetland 1. The areas of impact are shown on the project <br />plans in Figure 4. All of the fill impact is in Wetland 2 under jurisdiction of <br />the WCA and the USACE and all excavation impact is within the large <br />complex of Wetland 1 under the jurisdiction of the MNDNR and the <br />USACE. <br />4.6 Permitting <br />It is acknowledged that permits for excavation of the ponds within the <br />-! wetland are required by the MNDNR, and the USACE. A permit for filling <br />for the roadway is required by the WCA and USACE. The following <br />paragraphs describe the permits requested by this Wetland Permit <br />_ ± Application.. <br />4.6.1 Wetland Conservation Act -City of Roseville <br />The City of Roseville is responsible for administration of the WCA in the <br />project area. However, because all of the impacts from the pond construction <br />will occur in MNDNR Protected Water Wetland 62-137W, all of the <br />excavation. impacts to that wetland are outside of the jurisdiction of the WCA <br />and are under the jurisdiction of the MNDNR and the USACE_ <br />The proposed fill in Wetland 2 is outside of the jurisdiction of the MNDNR <br />and therefore under the jurisdiction of the City of Roseville and the WCA. <br />The proposed 0.02 acres of fill will require replacement in accordance with <br />the rules of the WCA.
