Our review was conducted in light of the <br />general joint power statute, Minn. Stat. § 471.59, the joint powers provision under Chapter <br />103B found at Minn. Stat. § 103B.211, and the Open Meeting Law. <br />We have only had a couple of comments. First, in Section III, subd. 11, regarding <br />meetings, in the notice provision for special meetings requires written notice of at least 48 <br />hours to the Board of Commissioners of the Joint Powers Entity. Under the Open Meeting <br />Law, persons who have requested written notice of a special meeting are generally required to <br />be given three days notice. Alternatively, there is to be publication of the notice three days <br />ahead of time. <br />While Minn. Stat. § 13D.04 subd. 7 indicates that actual notice of a meeting received by <br />a person at least 24 hours before a meeting satisfies all notice requirements of this section, <br />regardless of the method or receipt of notice, we think it would be better and avoid any <br />problems if subdivision 11 required commissioners to have three days written notice of the <br />
