7. Construction work authorized under this permit shall be completed on or before the date specified above. The permittee <br />may request an extension of. the time to complete the project, stating the reason thereof, upon written request to the <br />Commissioner of Natural Resources. <br />8. In all cases where the permittee by performing the work authorized by this permit. shall involve the taking, using, or <br />damaging of any property rights or interests of ahy other person. or persons, or of any publicly owned lands pr improvements <br />thereon or interests therein, the permittee, before proceeding, shaif obtain the written consen# of all persons, agencies, or <br />authorities concerned, and shall acquire all property, rights, and interests needed for the work. <br />This permit is permissive only. No liability shaif be imposed by the State of Minnesota or any of its officers, agents or <br />employees, officially or personalty, on account o€ the granting hereof or on account of any damage to any person or property <br />resulting from any act ar omission of the permittee or any of its agents, employees, ar con#ractors. This permit shall not be <br />construed as estopping or limiting any legal claims or righ# of action of any person other than the state against the permittee, <br />its agents, employees, or contractors, for any damage or injury resulting firom any such act or omission, or as es#opping or <br />limiting any legal claim or right of action of the state against the permittee, its agents, employees, or contractors for violation <br />of or failure to comply with the permit or applicable conditions. <br />10. Any extension of the surface of public waters from work authorized by this permit shaif become public waters and left open <br />and unobstructed for use by the public. <br />11. Where the work authorized by this permit involves the draining or failing of wetlands not subject to DNR regale#ions, the <br />permittee shall no# initiate any work under this permit un#il the permittee has obtained official approval from the responsible <br />local government unit as required by the Minnesota Wetland Conservation Act. <br />12. Any work below the water level shall be encircled by a flotation sediment curtain to prevent sediment from being transported <br />beyond the construction site. This sediment curtain shall be constructed and main#ained as illustrated an the enclosure <br />entitled "6.32 Treatment Measures: Flotation Silt Curtains." (Copy Enclosed) The barrier shall be removed upon completion <br />of the work. after the silt has settled. Note: Applicable only during open water <br />13. A report (i.e., map and brief description} shall be submitted to the Area Hydrologist describing the temporary and permanent <br />disposal of the excavation spoils. The excavation authorized by this permit shall not commence anti! the placement site for <br />moils has been approved in writing by the Area Hydrologist. <br />14. No activity affecting the bed of the peotected water may be conducted between April 4 and June 30, to minimize impacts on <br />fish spawning and migration. If work during this time is essential, it sheik be done only upon written approval of the Area <br />Fisheries Manager, at 651-259-5831. <br />15. Dredging equipment shall be inspected for Eurasian water milfoil and decontaminated following project completion andlor <br />when equipment is moved from one waterbody to ono#her. Every reasonable precaution shall be taken to prevent inoculation <br />of other waterbodies. DNR-Ecological Services {651-259-5100) may be contacted for information on how to decors#aminate <br />equipment. <br />16. The permittee shall ensure that the contractor has received and thoroughly understands ail conditions of this permit. <br />17. The channel area shall be clearly identified and posted as "Slow -No-Wake". <br />18.
