It is undersiood tnai: <br />' 1. The land landowner is responsible for t11e o�erati�n and maintenance of practices applied under this program to <br />ensure that the conservation objective of the practiee 'is met and the effective life, a minimum af 5 years, is <br />achieved. Shc�uld thc landowner fail to maintain the practiee during its effective life, the tandowner is liable to the <br />Grass Lake VJater Mana�ement drganization (GLWMn) far the full am�unt of fnancial assrstance received ta <br />install and establish the practice. The landowner is not liable for cast-share assistance received if, (in the judgment <br />of the Ramsey Conservation District (RGD), the faiture �vas caused by reasons beyond the landow-ner's control, or i£ <br />conservation practice(s) are applied at the landowner's expense that provide equivalent protection of the st��l and <br />water resources. <br />In no case shall the GLWMO provide cost-share assistance to a land�wner for the reapplication of a practice that <br />was removed by the landowner during its effective life without consent of the GLWMO Board ar that faited due to <br />improper maintenance. The specific o�eratio�� an� maintenance requirements foi- tlle conservation practice listed are <br />described in the operation and maintenance plan prepared for this coni�-act by the RCD technical representative. If <br />title to this land is transferred to ano#her party before expiration of the aforementione� Iife, it shall be the <br />responsibiliry of the landowner who signed this contract to advise the new owner that this contract is in force. � <br />f'ractiee (s) must be planned and insfalled in accordance with technical standards and specifications of the <br />RCD. <br />3_ Inereases in the practice units or cast must be approved by the RCll Kepresentative as a condition to increase the <br />cost-share payments by amendment. <br />This contract, when approved by the RCD Representative, will remain in effect unless canceled by rnutual <br />agreement. <br />Practices will be instal]ed by �''w t°,����- �`;� unless this contract is arnended by mutual oonsent to rescheduie the <br />work and funding. <br />' 6. Items of cost for which reimbursement is sought must be supported by invoices/receipts for payments and will be <br />verified and approved for payment by the GLWMU Board as practica] and reasonable.
