06/06/05 <br />[REVISOR ) RR/MD AR3501ST <br />1 Upon receiving an emergency excavation notice requesting an <br />2 immediate response, an operator shall: <br />3 A. attempt to contact the excavator within one hour <br />4 at the telephone number provided in subpart 1, item C, to <br />5 provide any information concerning facilities at or near the <br />6 area of excavation including an anticipated response time; and <br />7 B. locate and mark .the underground facility within <br />8 three hours of notice unless: <br />9 (1) otherwise agreed between the parties; <br />10 (2) the operator notifies the excavator that not <br />11 locating does not present an immediate danger to life or health, <br />12 or a significant loss of property; or <br />13 (3) there is an event or situation that cannot be <br />14 reasonably anticipated or controlled by the operator. <br />15 Subp. 4. Emergency notice requesting scheduled response. <br />16 Upon receiving an emergency excavation notice that does not <br />17 require an immediate response, and before the scheduled <br />18 excavation start date and time, an operator shall: <br />19 A. locate and mark the underground facility, unless <br />20 otherwise agreed between the parties; or <br />21 B. notify the excavator at the telephone number <br />22 provided in subpart 1, item C, that there is not an underground <br />23 facility within the area of proposed excavation. <br />24 For purposes of this subpart, a requested start time of <br />25 three hours or less from the time notice is provided to the <br />26 center is considered an emergency notice requesting immediate <br />27 response under subpart 3. <br />6 <br />
