b. Variances shall only be issued by a community upon (i) a showing of <br />good and sufficient cause, (ii) a determination that failure to grant the <br />variance would result in exceptional hardship to the applicant, and (iii) <br />a determination that the granting of a variance will not result in <br />increased flood heights, additional threats to public safety, <br />extraordinary public expense, create nuisances, cause fraud on or <br />victimization of the public, or conflict with existing local laws or <br />ordinances. <br />c. Variances shall only be issued upon a determination that the variance <br />is the minimum necessary, considering the flood hazard, to afford <br />relief. <br />11. Appeals: The decision of the Variance Board may be appealed by the <br />applicant or by any other Roseville property owner within 10 days of the <br />decision. Appeals are heard by the City Council which acts as the Board of <br />Zoning Adjustments and Appeals. An appeal is a matter of public record, <br />but it does not require a public hearing and no new information will be <br />reviewed as part of the appeal; the Board of Zoning Adjustments and <br />Appeals will simply review the Variance Board's decision-making process <br />to determine whether it complied with City Ordinances and State Statutes. <br />12. Flood Insurance Notice and Record Keeping. The Community <br />Development Department shall notify the applicant for a variance that: 1) <br />The issuance of a variance to construct a structure below the base flood <br />level will result in increased premium rates for flood insurance up to <br />amounts as high as $25 for $100 of insurance coverage and 2) Such <br />construction below the 100-year or regional flood level increases risks to <br />life and property. Such notification shall be maintained with a record of <br />all variance actions. A community shall maintain a record of all variance <br />actions, including justification for their issuance, and report such variances <br />issued in its annual or biennial report submitted to the Administrator of the <br />National Flood Insurance Program. <br />D. Conditional Use: <br />1. Overview: Conditional Use applications will be reviewed by City staff and <br />discussed in a public hearing by the Planning Commission, which meets <br />on the first Wednesday of each month, before a decision to approve or <br />.deny the application is made by the City Council at its regular meeting on <br />the fourth Monday later that month. <br />2. Application Deadline: Applications must be received by the close-of- <br />business on the first Friday of each month; applications received after this <br />date cannot be heard at the Planning Commission meeting of the following <br />month. Minnesota State Law requires that a decision be issued for each <br />application within 60 days of the submission of a complete application <br />-20- <br />
