Mr. Brinkman advised that the Association was willing to <br />bear the cost to bring the road up to City standards. <br />Discussion among Councilmembers, staff and petitioners and their legal counsel <br />included increased usage; past and current practice in residential developments <br />and private versus public roadways; setback and right of way considerations; sim- <br />ilar associations with private roads (i.e., Westwood Village, Calibre Ridge, and <br />the mobile home community across from City Hall on County Road C and Lex- <br />ington); status of this particular development as a Planned Unit Development <br />(PUD) and the normal street grid not being applicable; City design standards; <br />original developer Art Mueller for Phases I and II; and five additional short roads <br />that consisted of cul-de-sacs that are not asked to be included in this proposal due <br />to their applicable design status. <br />Further discussion included a history of Ferns Lane and Gluek Lane and original <br />plans for 2-3 more units that were not pursued; similar action in the City of <br />Mounds View with Silver Lake Road Condominiums; unanimous support by both <br />Association Boards, and majority support indicated by homeowners, depending <br />on how an agreement was structured; and options for cost-sharing. <br />Ms. Bloom advised that staff was proceeding with this request under the Minne- <br />• sots Statutes, Chapter 429 process for public improvement projects. <br />Additional discussion included other examples (i.e., Reservoir Woods); safety and <br />access issues related to costs to taxpayers to bring the road up to City standards if <br />a need was so determined. <br />Mayor Klausing expressed concern in making a case for public versus private in- <br />terest; however, with the Associations willing to bear the cost for the Feasibility <br />Study, he opined that he was willing to take that preliminary step before making a <br />final determination. <br />Councilmember Pust spoke in support as long as the Associations understood that <br />the cost of the Feasibility Report was their undertaking. <br />Ms. Bloom advised that staff would recommend, if the City accepted the road, it <br />be signed as "No Parking;" to avoid severe impacts to buildings due to any road <br />widening and setback requirements, and estimated that installation of curb and <br />gutter would be approximately $60,000. Ms. Bloom further noted that soil bor- <br />ings had been done to-date, but further discussion with the Association Boards <br />and their legal counsel would determine the Chapter 429 process and cost, and <br />other problems (i.e., setbacks) could be negotiated with the City's Planning De- <br />partment. <br /> <br />
