<br />WHEREAS, the Village desired to acquire an <br /> <br />easement over and upon and across said land for the purpose <br /> <br />of draining water and ponding water for the storm sewer <br /> <br />system of the Village; and <br /> <br />WHEREAS, Henry B. Blumberg and Jean H. Blumberg, <br /> <br />husband and wife, and Robert C. Blumberg and Claudia M. <br /> <br />Blumberg, husband and wife, and Elizabeth Blumberg Putman, <br /> <br />the predecessors in interest to Zimmerman Realty, a <br /> <br />partnership, and former record owners of the above described <br /> <br />property, executed an agreement for said aforementioned <br /> <br />easement on April 16, 1962, which agreement-easement was <br /> <br />inadvertently not filed for record before the conveyance <br /> <br />of said property to zimmerman Realty, a partnership, a copy <br /> <br />of which Agreement is attached hereto, marked Exhibit "A" <br /> <br />and included herein by reference; and <br /> <br />WHEREAS, the Village of Roseville has drained <br /> <br />and ponded water in accordance with said agreement attached <br /> <br />hereto since April 16, 1962, <br /> <br />NOW, THEREFORE, the Owner hereby grants and <br /> <br />conveys unto the Village and its assigns an easement over <br /> <br />and upon the following described real property, to-wit: <br /> <br />The Northwest Quarter of the Southwest <br />Quarter (~~~ of SW~) of Section Ten (10), <br />Township Twenty-nine (29), Range Twenty- <br />three (23), subject to the rights acquired <br />by the State of Minnesota for highway <br />purposes, which lies below an elevation <br />of 929.0 feet sea level from U.S.G.S. datum. <br /> <br />That the estate conveyed is a perpetual easeme~t <br /> <br />for the purpose of draining water and ponding water upon said <br />
