General Density Requirements, Exceptions and Credits: <br />1. The total minimum lot requirements for structures housing three or more dwelling <br />units in any R district may be reduced by 100 square feet per dwelling unit if the <br />property involved is contiguous to a B or an I district. <br />2. The total minimum lot area requirements for structures housing three or more <br />dwelling units in any R district may be decreased by 300 square feet for each parking <br />space that is provided under the principal use structure or, in some other manner, <br />underground which allows use of the grade level above such space for other parking, <br />yard or recreation space. <br />(Ord. 1287, 8-4-2003) <br />C. General Lighting Regulations: Any illumination, whether affixed to a building or <br />otherwise, within a lot in any R district shall not be permitted to beam beyond the lot <br />lines wherein it is located. Pre-existing Setbacks: If, after May 21, 1959, existing houses on 50% or more of the <br />frontage of any block have a predominant front yard different from that herein <br />specified, all buildings hereafter erected shall conform to the average front yard set- <br />back of the two adjacent houses on the same side of the street, provided this <br />regulation shall not be interpreted so as to require a front yard of more than 40 feet in <br />depth. Policy: It shall be the stated policy of the City to maintain a harmonious and high <br />standard of residential development and to protect such areas from deleterious effects <br />through ensuring that both new and relocated dwellings from other areas, both within <br />the City and from outside, shall meet specified requirements. <br />2. Relocations Permitted On Condition: Relocations of dwellings shall be permitted <br />in the zoning district where all necessary specifications as to lot sizes, setbacks, type <br />of use, height regulations and all other conditions as laid down in this Title are met. <br />(Ord. 275, 5-12-1959) <br />3. Relocation Permit Required; Application: <br />a. Relocations, except to adjacent lots on the same side of the street, shall require <br />a relocation permit utilizing the notice and hearing procedure set forth for <br />condition use permits. <br />b. The applicant shall provide a performance security to the City in an amount to <br />be determined by the City Council. <br />c. Chief Code Enforcement Officer shall provide a report to the City Council and <br />after hearing the matter the City Council may grant or reject the issuance of a <br />permit. Purpose: The purpose of the home occupation regulations is to provide an <br />opportunity for home occupations, while ensuring that such home occupations do not <br />have an adverse impact on the character and livability of the surrounding <br />neighborhood. The home occupation regulations also ensure that the home <br />occupation is secondary and subordinate to the principal residential use of the <br />property. <br />2. Standards: Home occupations shall be subject to the following standards: <br />a. Home occupations shall only be conducted by the resident of the dwelling, and <br />within the principal residential structure or dwelling. Not more than 30% of the <br />floor area of the dwelling, to a maximum of 600 square feet, may be used for such <br />purposes. The home occupation shall be conducted entirely within the dwelling. <br />
