Roseville is required to pay such a penalty for a day on which Arden Hills exceeds its agreed total maximum discharge into Roseville I then Roseville may increase the aforesaid penalty to Arden Hills for such day to Six Hundred Dollars ($600.00); provided, however, that the total penalty assessed by Roseville for anyone day I against Arden Hills and any other connecting suburb I will not exceed Six Hundred Dollars ($600.00) per day. In any event I however I Roseville agrees it will not contract with any other suburb for sewage without an identical provision a s this Section 8. SECTION 9. RESPONSIBILITY FOR CLAIMS OR ACTION FOR DAMAGES. Arden Hills agrees to save Roseville and the City of St. Paul harmles s from any damage I cost or expense and fully indemnify said Roseville and the City of St. Paul against any and all liabilities sustained by reason of connection or maintenance of connections hereunder between the said public sewer system of Arden Hills and the said public sewer system of Roseville and the City of St. Paul, or by reason of any damage, cost, expense or loss that may be sustained by Arden Hills, its inhabitants, or any other person or persons connected with the use of said Arden Hills I public sanitary sewer system or by reason of the diversion into said Arden Hills' public sewer system of roof water or storm water drainage; pro vided however I that notwithstanding the foregoing Arden Hills shall not be required to indemnify or save Roseville harmless against any damage, cost, expense, claim or liability caused by reason of negligence of Roseville, the City of St. Paul, or agents or employees of either of said municipalities.
