Section 2.03. Council composition and election. <br />The council shall be composed of a mayor and four or six councilmembers, as <br />determined by the council who shall be qualified electors. Each councilmember shall <br />serve for a term of four years and until his or her successor is elected and qualifies. The <br />mayor shall serve for a term of four years and until his or her successor is elected and <br />qualif es. The Council may provide by ordinance for the election of city council <br />members by wards. The ordinance may also provide for staggering ofterms. Minnesota <br />election law, including Minnesota statutes 204F3.135 and 205.8, as they may be <br />amended from time to time, relating to wards, applies to any wards established by the <br />council <br />Section 2.04. Incompatible offices. <br />No member of the council shall be appointed city manager, nor shall any member <br />hold any paid municipal office or employment under the city; and until two years after <br />the expiration of his ar her term as mayor or councilmember na former member shall be <br />appointed to any paid appointive office or employment under the city which was created <br />or the compensation for which was increased during his or her term as councilmember. <br />Section 2.05. Vacancies. <br />An elective office becomes vacant when the person elected or appointed thereto <br />dies before taking office or fails to qualify, or the incumbent dies, resigns in writing filed <br />with the city manager, is convicted of a felony, ceases to reside in the city, or is adjudged <br />incompetent by a court of competent jurisdiction. If the unexpired term of the council <br />vacancy is less than one year from the date of the occurrence of the vacancy, the council <br />by a majority vote of all its remaining members shall appoint a qualified person to fill the <br />vacancy. If the council fails to make the appointment within sixty ((i0 j days of the <br />occurrence of the vacancy, the mayor shall fill the vacancy from the list of qualified <br />applicants. If the unexpired term of the council vacancy is one year or longer from the <br />date of the occurrence of the vacancy, a special election shall be called by the city <br />manager to fill the vacancy. <br />Subdivision 1. Procedures to Fill Council Vacancies by Special Election. <br />If the unexpired term of the cauncil vacancy is one year or longer, a <br />special election shall be called by the city manager. The election will be held not <br />sooner than ninety (90) days and not later than one hundred twenty (I20j days <br />following the occurrence of the vacancy and will otherwise be governed by the <br />provisions of Section 4.02, Special Elections. <br />Subdivision 2.
